2. Privacy notice

HERAPORT is the data controller for the personal data collected through this site. This notice explains what we collect, why, and what rights you have.

What we collect

  • Details you provide in the enquiry form: name, company, email, telephone and the commercial information you choose to include.
  • Your language preference, stored locally in your browser so the site opens in the same language next time.

Why we collect it

  • To answer your enquiry and, where it leads to business, to negotiate, fix and administer the resulting charter.
  • To comply with our legal obligations, including record keeping.

How long we keep it

Enquiries that do not lead to business are kept for up to 24 months. Data relating to a concluded fixture is kept for the period required by applicable commercial and tax law.

Who has access

Your data is used by HERAPORT and, where necessary to carry out your instructions, shared with counterparties, agents, owners or service providers involved in the transaction. It is never sold and never used for advertising.

Your rights

You may request access to, rectification of, cancellation of or opposition to the processing of your personal data (ARCO rights under the Mexican Federal Law on Protection of Personal Data Held by Private Parties). If you are located in the European Union, you also hold the rights of access, rectification, erasure, restriction, portability and objection under the GDPR. Write to teresa@heraportmarine.com and we will answer within the statutory period.

Cookies

This site sets no advertising or analytics cookies. The only information stored on your device is your chosen language, kept in local storage and removable at any time by clearing your browser data.

3. Terms of business

Our capacity

HERAPORT acts as a commercial intermediary and broker. Unless expressly agreed in writing, we are not a carrier, a shipowner, a disponent owner or a party to the charter party. Contracts are concluded between the principals themselves.

Offers and indications

Rates, positions and tonnage lists are indications only, given in good faith on the basis of information available at the time, and are subject to the vessel or cargo remaining unfixed and to the principals' final agreement.

Commission

Address and brokerage commission is agreed and disclosed before firm offers are exchanged and is recorded in the recap and the charter party.

Liability

Information on this website is provided for general information and does not constitute an offer, advice or a warranty of availability. To the extent permitted by law, HERAPORT is not liable for indirect or consequential loss arising from its use.

Governing law

These terms and the use of this website are governed by [governing law — to be completed], without prejudice to the law and jurisdiction agreed in each individual charter party.

Usted puede ejercer sus derechos de Acceso, Rectificación, Cancelación y Oposición (derechos ARCO) conforme a la Ley Federal de Protección de Datos Personales en Posesión de los Particulares. Si se encuentra en la Unión Europea, dispone además de los derechos de acceso, rectificación, supresión, limitación, portabilidad y oposición previstos en el RGPD. Este sitio no instala cookies publicitarias ni analíticas. La única información guardada en su dispositivo es el idioma elegido, almacenado localmente y eliminable en cualquier momento borrando los datos del navegador.

3. Condiciones de servicio

Nuestra calidad

HERAPORT actúa como intermediario comercial y broker. Salvo acuerdo expreso por escrito, no somos porteador, armador, armador disponente ni parte de la póliza de fletamento. Los contratos se celebran entre los propios principales.

Ofertas e indicaciones

Tarifas, posiciones y listas de tonelaje son meramente indicativas, se ofrecen de buena fe con la información disponible en ese momento y quedan sujetas a que el buque o la carga sigan libres y al acuerdo final de las partes.

Comisión

La comisión de dirección y corretaje se acuerda y se declara antes del intercambio de ofertas firmes y queda registrada en el recap y en la póliza de fletamento.

Responsabilidad

La información de este sitio se ofrece con carácter general y no constituye oferta, asesoría ni garantía de disponibilidad. En la medida permitida por la ley, HERAPORT no responde por daños indirectos o consecuenciales derivados de su uso.

Ley aplicable
